Mansuh PTPTN: Hikayat Perhimpunan di Dataran Merdeka dan Tokoh Warganegara yang TERLALU Bijak Pandai

Merujuk kepada video di youtube.com....


 Hamba Allah ini cuba untuk tunjuk pandai..... Kononnya dialah yang tahu segala-galanya... ni nama dia bodoh sombong.....

Cuba lihat kepada "Keluhuran Perlembagaan' yang cuba di dokong beliau. Impian yang murni dalam mendokong prinsip-prinsip rukunegara, tetapi jahil dalam perlaksanaanya yang hakiki. Saya pun tidak lah sepandai mana dalam bidang perundangan, tetapi rasanya Perlembagaan adalah asas kepada sesuatu negara dan ianya di laksanakan dengan artikel-artikel dan undang-undang yang sewajarnya. Begitu juga pelaksana/penguatkuasa undang-undang yang dalam konteks ini adalah DBKL. Di mana mereka bertindak dengan undang-undang dan peraturan DBKL/ pihak berkuasa tempatan (PBT). Yang mana, peraturan-peraturan ini adalah berlandas kepada undang-undang dan tunjangnya adalah perlembagaan.

 Dinyatakan oleh hamba Allah tersebut yang pihak DBKL telah menafikan hak rakyat untuk berhimpun seperti yang termaktub di dalam Perlembagaan Persekutuan, Artikel 10.

Mengikut artikel 10 ini:

Artikel 10  Perlembagaan Persekutuan

kebebasan bercakap berhimpun dan menubuhkan persatuan

(1) tertakluk kepada fasa(2),(3) dan (4);
(a)tiap2 warga negara berhak bebas bercakap dan mengeluarkan fikiran.
(b)semua hak berhimpun secara aman dan dgn tidak bersenjata;
(c) semua warganegara adalah berhak menubuhkan persatuan.

Namun, Artikel 10 Perlembagaan juga menyatakan beberapa perkara lagi seperti dibawah:

2) Parlimen boleh dgn undang2 mengunakan :
(a) keatas hak2 yg diberikan oleh perengggan(a) Fasal (1) apa2 sekataan yg didapatinya perlu atau mustahak demi kepentingan keselamatan Persekutuan atau mana2 bahagiannya, perhubungan persahabatan dgn negeri2lain, ketenteraman awam utk melindungi keistimewaan2 parlimen atau mana2 Dewan Negeri atau mengelakkan terhadap mahkamah,fitnah,atau perbuatan mengapi2 supaya dilakukan sesuatu kesalahan:

(b) Keatas hak yg diberikan oleh perenggan (b) Fasal (1),apa2 sekatan yg didapatinya perlu atau mustahak demi kepentingan keselamatan Persekutuan atau mana2 bahagiannya,atau ketenteraman awam.

(c) keatas hak yg diberi oleh perenggan (c) Fasal (1) apa2 sekatan yg didapatinya perlu atau mustahak demi kepentingan keselamatan Persekutuan atau mana2 bahagiannya,atau ketenteraman awam atau akhlak.

(3) Sekatan2ke atas hak menubuhkan persatuan yang diberikan oleh perenggan (c) Fasal (1) boleh dikenakan oleh mana@ undang@ mengenai buruh atau pelajaran

(4) pada mengenakan sekatan2 demi kepentingan keselamatan Persekutuan atau mana2 bhgnya atau ketenteram awam di bawah Fasal (2)

(a),Parlimen boleh meluluskan undang2 melarang perbuatan mempersoalkan apa2                    perkara,hak,taraf,kedudukan,keistimewan,kedaulatan yang ditetapkan atau perlindung oleh peruntukan Bahagian 3,perkara 152,153 dan 181 berhubung dgn perlaksanaanya sebagaimana yang dinyatakan dalam undang2 itu.

Fakta-fakta di atas jelas menunjukkan bahawa walaupun hak rakyat untuk berhimpun aman, ianya bukanlah mutlak.  Proses yang melibatkan keselamatan negara harus disalurkan kepada saluran yang betul.  Dalam perkara ini, Parlimen telah mengakui bahawa KDN dan PDRM telah diberikuasa untuk menilai samada perhimpunan mengancam keselamatan negara, atau tidak.

Ia merujuk kepada permit yang mesti diperolehi oleh penganjur sebelum acara boleh dijalankan.  Dan PDRM punya kriteria-kriteria yang perlu dipenuhi oleh pengajur sebelum permit dikeluarkan.  Inilah yang dimaksudkan dengan Perkara 2 dalam artikel 10.

Kesimpulannya, mamat tu cakap tapi tak paham erti percakapannya.... Lawan cakap dengan orang-orang DBKL boleh le bro.....

The chronology of events



2007-2008
National Feedlot Corporation Sdn Bhd (NFCorp) mandated as an integrator for the National Feedlot Centre (NFC), a project to meet 40 per cent of national beef production by 2010. NFCorp is owned by Agroscience Industries Sdn Bhd with participation from the federal government. A 809ha site in Gemas, Negri Sembilan, is identified for cattle rearing.

2009

Funds from RM250 million government soft loan channelled to special account.

2010

Contract between NFCorp and government signed.



2011

• October: Auditor-General’s 2010 Report reveals NFC achieved only 41.1 per cent of production target.

• Nov 10: Parti Keadilan Rakyat (PKR) strategic director Rafizi Ramli reveals NFCorp paid RM9.8 million from National Meat and Livestock Corporation (NMLC), a subsidiary contracted as NFC’s marketing development agent, for a luxury condominium in Bangsar. Report lodged with the Malaysian Anti-Corruption Commission (MACC).

• Nov 14: MACC hands over investigations on purchase of condominium to police.

• Nov 18: NFC executive chairman Datuk Seri Dr Muhamad Salleh Ismail reveals the NFC bought not one but two condominiums at One Menerung. He defends the purchase as a longterm investment and clarifies the production of cattle in 2010.

• Nov 23: Wanita PKR launches nationwide effort to lodge police reports over NFC issue. Its chief Zuraida Kamaruddin says five key individuals in the controversy would be named. She calls for Shahrizat to resign.

• Nov 24: Police question Dr Muhamad Salleh over possible criminal breach of trust involving NFC. Public Accounts Committee starts investigations into NFC issue.

• Nov 28: Women, Family and Community Development Minister Datuk Seri Shahrizat Abdul Jalil breaks silence over NFC issue, says she has nothing to do with the matter.

• Nov 30: At the Umno general assembly, Shahrizat hits back at PKR for asking her to resign, saying she is only the wife of the NFCorp chairman and had nothing to do with NFC. Rafizi reveals again that NFC had transferred RM3,363,507 to NMLC to buy land in Putrajaya in December 2009 and bought a Mercedes Benz CLS 350 CGI for RM534,622.

• Dec 21: Police arrest a Datuk for allegedly trying to bribe several investigating offi cers over the NFC issue. Dr Muhamad Salleh denies the 45-year-old businessman is related to him. Prime Minister Datuk Seri Najib Razak denies Shahrizat has offered to resign from the cabinet.

• Dec 23: MACC officers raid NFC office in Mont Kiara.

• Dec 29: Datuk Shamsubalhrin Ismail, CEO of Shamsulbahrin Ismail Resources Sdn Bhd charged with promising a false consultation service to Dr Muhamad Salleh, and also with deceiving Dr Muhamad Salleh into handing over RM1.755 million between Nov 25 and Dec 6.

2012

• Jan 13: Shahrizat goes on three-weeks leave until Feb 5.

• Jan 19: Shahrizat files RM100 million defamation suit against Rafizi and Zuraida.

• Jan 27: Shamsulbahrin lodges police report, stating he was made a scapegoat of the scandal, saying he received calls and SMSes from an NFCorp official who “pressured me to bribe police to close the NFC case”.

• Feb 1: Auditor-General Tan Sri Ambrin Buang clarifies that terms such as “mess” were not used to describe NFC in his report for 2010.

• Feb 7: Rafizi says two condominiums worth RM34.6 million at Marina Bay suites, located in the posh Marina Bay Financial Centre, Central Boulevard, Singapore were registered under Dr Muhamad Salleh and his son and NFCorp executive director Wan Shahinur Izran Salleh.



• Feb 8: Shahrizat gives statement to MACC, saying she has no part in NFCorp’s dealings.

• Feb 9: Wan Shahinur defends purchase of condominium units in Singapore, saying it was made when there was a lull in business after the government halted the building of an export quality abattoir that was to be rented to NFCorp.

• Feb 26: Police recommend that the Attorney-General’s Chambers charge NFCorp directors with CBT. Police also investigate the case as cheating.

• Feb 29: Rafizi reveals that NFCorp subsidiary, Farmhouse Supermarkets Pte Ltd, rented space for RM2.2 million a month to open a supermarket in Rochester Mall, Singapore. Dr Muhamad Salleh says the supermarket is necessary as the local market cannot support the company’s beef production.

• March 7: Rafizi reveals that NFCorp used the RM250 million soft loan as leverage to obtain loans for eight shoplots in KL Eco City development in Jalan Bangsar. The shoplot units are reportedly worth a forced-sale value of RM9.69 million. On the same day, online news portal The Malaysian Insider reveals commercial crimes police were investigating NFCorp’s purchase of a RM1.7 million apartment in Almaty, Kazakhstan, for use as an office. NFCorp denies the purchase of the KL Eco City property, saying it is the directors’ “private investment”.

• March 11: Shahrizat announces she will resign her cabinet post on April 8 when her term as senator ends. She says she will remain Wanita Umno chief.

KUALA LUMPUR: Kadar hutang negara masih pada paras yang boleh diurus dan Malaysia tidak akan muflis menjelang 2020 seperti yang didakwa sesetengah pihak, kata bekas Menteri Kewangan, Tun Daim Zainuddin.

Di samping itu, segala pinjaman yang dibuat oleh kerajaan adalah bersumberkan daripada pinjaman domestik, kata Daim, yang juga merupakan penasihat ekonomi kerajaan Malaysia pada tahun 1990an. "Satu perkara penting mengenai hutang negara adalah kebanyakannya ia diperoleh daripada pinjaman domestik. "Jenis pinjaman ini lebih stabil dan tidak mendedahkan Malaysia kepada aliran keluar modal besar secara tiba-tiba," katanya dalam wawancara bersama Mingguan Malaysia yang disiarkan semalam.

Daim berkata, walaupun beberapa penganalisis bimbang kadar hutang negara dijangka meningkat 1.3 peratus kepada 54.8 peratus dari Keluaran Dalam Negara Kasar (KDNK) pada tahun ini, berbanding 53.1 peratus pada 2010, kenaikan ini adalah wajar sebagai tindak balas terhadap krisis kewangan global yang bermula pada penghujung 2008.

"Kenaikan terkini adalah disebabkan oleh kemelesetan ekonomi dunia dan subsidi besar yang diperlukan untuk menampung kenaikan harga barang makanan dan tenaga," katanya.

Beliau menegaskan paras hutang negara tidak mungkin mencapai 100 peratus pada 2019 kerana pihak kerajaan telah berazam untuk mengurangkan defisit fiskal kepada 4.7 peratus pada 2012 yang akan mengurangkan keperluan kenaikan dana (hutang).
Justeru, beliau berkata situasi hutang negara tidaklah amat mencemaskan seperti yang dicanang oleh beberapa pihak.

"Secara peribadi saya akan menasihatkan kerajaan untuk mengawal dan menurunkan hutang berkenaan.

"Ini baik untuk kerajaan dan juga menjawab segala kritikan mengenai isu berkenaan," katanya. - BERNAMA

KUALA LUMPUR: Pelancaran awal cadangan syarikat penerbangan jarak dekat baharu oleh syarikat penerbangan negara, Malaysia Airlines, dijangka mengambil tempat bulan depan, kata Ketua Pegawai Operasi (Jarak Dekat), Ignatius Ong.

Beliau berkata, syarikat penerbangan baharu itu yang masih lagi belum diberikan nama, dijangka beroperasi sepenuhnya menjelang pertengahan tahun ini. "Pada April, kami berhasrat melancarkan nama serta logonya. Bagaimanapun, kami masih lagi mensasarkan operasi sepenuhnya pada pertengahan tahun ini," kata beliau ketika taklimat media di sini hari ini. Syarikat penerbangan jarak dekat itu diperkenalkan oleh pasukan pengurusan baharu Malaysia Airlines yang diketuai oleh Ketua Pegawai Eksekutif Kumpulan, Ahmad Jauhari Yahya, sebagai sebahagian daripada rancangan pemulihan perniagaan syarikat itu.

Syarikat penerbangan baharu itu akan menggunakan sepenuhnya rangkaian baharu pesawat Boeing 737-800 dan ia khusus disasarkan untuk memenuhi kehendak pengembara mewah.

Malaysia Airlines mencatatkan kerugian bersih RM2.52 bilion untuk tahun kewangan berakhir 31 Disember 2011, yang terbesar dalam sejarah korporatnya dengan pendapatan RM13.9 bilion. - BERNAMA

KUANTAN 29 Feb. - Tanggungjawab untuk mengundi pada pilihan raya umum adalah sesuatu yang wajib, kata Mufti Pahang Datuk Abdul Rahman Osman.

Beliau berkata, mereka yang layak mengundi wajib berbuat demikian dalam membentuk sebuah kerajaan yang dapat membela kesucian agama dan keamanan.

"Pada zaman Rasulullah SAW dahulu ketika baginda wafat, waktu untuk pengkebumian terpaksa ditangguh sebentar sebelum dikebumikan bagi melantik seseorang yang boleh memikul tanggungjawab sebagai khalifah.

"Daripada situ kita sudah dapat melihat betapa penting pelantikan khalifah itu kepada masyarakat untuk melaksanakan agenda seterusnya ke jalan yang benar,” katanya kepada pemberita di sini, hari ini.

Beliau berkata, mengundi adalah satu fardu kifayah, bagaimanapun sekiranya ramai tidak melaksanakannya sehingga boleh menjejaskan pembentukan sesebuah kerajaan, maka tanggungjawab itu akan menjadi fardu ain. - BERNAMA

His Excellency Mr Yitzhak Rabin Prime Minister of Israel JERUSALEM

I would like to thank you for your letter of 17 October informing me about the Agreement of Principles and Mutual Recognition between Israel and the PLO.

My government supports this positive development and views it as a first step towards the realization of a comprehensive solution to the Middle East problem.

As a demonstration of Malaysia’s support to this development my country was represented at the Donor’s Conference to support The Middle East Peace held in Washington and subsequently pledged a modest financial contribution to the Palestinians to assist in their new tasks. My government has also offered the Palestinians technical assistance under the Malaysian Technical Cooperation Programme.

Malaysia as a matter of general principle is prepared to develop relations with Israel at the appropriate time. In the meantime, we would like to see tangible progress in the implementation of the peace agreement.

The Middle East problem particularly the Palestinian issue has been a cause of instability to the region and I hope the recent agreement between Israel and PLO would contribute to lasting peace to the area.

I look forward to normal relations with Israel. (this last sentence is hand written)

PRIME MINISTER MALAYSIA 14 March 1997 His Excellency Mr Benjamin Netanyahu Prime Minister of Israel JERUSALEM

Your Excellency,

Your letter dated January 23rd only reached me yesterday. I appreciate very much your taking the trouble to inform me on the situation in Palestine and the region.

Unfortunately much of what you have written has been overtaken by events.

Malaysia believes in peace and in settlement of problems between neighbours through negotiations. As a last resort, we turn to third parties.

In disputes over territories between Malaysia and Singapore and Malaysia and Indonesia we have agreed to get the World Court to decide.

Dispute between Malaysia and Thailand over territorial waters was resolved by agreeing to share the non-marine resources equally.

Within the country, disparities in wealth distribution between the indigeneous people and those of immigrant origins were resolved through affirmative action in which the have nots would have a bigger share of a growing economic cake but there would be no expropriation and redistribution of what already belonged to the descendants of immigrants.

Everyone has very nearly a fair share now and everyone is fairly satisfied. Relations between the different races in Malaysia are good and not disruptive.

The important point I would like to stress is not to take what already belongs to others even though historically they may be yours. Lately, Israel has been pulling down Arab dwellings in order to erect houses for Israelis.

The whole world, including your ally, the United States condemns this. But Israel has gone ahead.

You condemn Syria for making threats. But their threats are the response to your own action. If you forcibly take over land and property belonging to the Palestinians, the only response if they are not to violently act against you, is to threaten to act against you.

If they cannot retaliate and they cannot voice their intended retaliation, than they would have to submit to all your action no matter how wrong. What you are doing now is against the spirit and the letter of the peace process agreed to by your predecessor.

How can we trust Israel if a change in the government negates solemnly given undertakings by a Government of Israel. Please reconsider your decision to build new Jewish settlements on Arab land.

The Israeli youths are here. Our intention is to show them that Muslims are normal rational people who want to live in peace and freedom. We hope that they will have a new impression of Muslims and Islam.

There will be aberrations among Muslims but there are also aberrations among Jews and Christians and people of every religion. No religion should be judged by these aberrations.

We hope that the youths will understand Muslims better and will want to be at peace with them. To have peace you have to make sacrifices. The Palestinians no longer demand the elimination of Israel. They are even prepared to share Jerusalem with you. They have made sacrifices.

We should remember that when Jews were persecuted in Europe, they had always found sanctuary among Muslims in Muslim countries. We don’t regard Israelis as eternal enemies. But we cannot help but sympathise with the Palestinians because their land is being taken away from them now.

It may have belonged to Jews three thousand years ago. A lot of traditional Malay land have been made part of Thailand. But we are not claiming Southern Thailand as part of Malaysia. If we go too far into the past we cannot live with our neighbours.

We are ready to have economic and technological cooperation with Israel but we cannot do so yet because you have not honoured commitments made by a legitimate Government of Israel.

We would like to think that once we have established relations with you, it would be permanent.
